PRIVACY POLICY OF KW CONSTRUCTION INŻ. KRZYSZTOF WILCZEWSKI

1. This Privacy Policy sets out the rules for the processing of personal data obtained through the website www.kwconstruction.eu (hereinafter referred to as “Website“).

2. The owner of the Website and at the same time the administrator of personal data is KW Construction inż. Krzysztof Wilczewski, ul. Starowiejska 126, 16-010 Dąbrówki, Poland, VAT EU: PL9661817441, REGON: 052192683, hereinafter referred to as KWC.

3. Personal data collected by KWC via the Website is processed in accordance with Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free flow of such data and repeal Directive 95/46 / EC (general regulation on data protection), also referred to as the GDPR.

4. KWC makes special care to respect the privacy of Users visiting the Website.

§ 1 The type of data processed, the purposes of processing and the legal basis.

1. KWC collects information on natural persons conducting legal transactions not related directly to their activities, natural persons conducting business or professional activity on their own behalf, and natural persons representing legal persons or organizational units that are not legal entities to whom the act grants legal capacity, conducting business activity on its own behalf or professional, hereinafter referred to jointly as Users.

2. Users’ personal data is collected when using the contact form service on the Website to perform a contract provided electronically. Legal basis: Necessity to perform a contract for the provision of the contact form service (Article 6 (1) (b) of the GDPR) or in the case of using the contact form service for job offers posted by the KWC for the recruitment of employees.

3. If you use the contact form service in the CONTACT tab, the User gives: Name and surname, e-mail address, telephone number and the company he represents.

4. In the case of using the contact form service in the CAREER tab, the User provides: Name and surname, e-mail address, telephone number.

5. When using the Website, additional information may be downloaded, in particular: the IP address assigned to the User’s computer or the external IP address of the Internet provider, domain name, browser type, access time, type of operating system.

6. Users may also collect navigation data, including information about links and links in which they choose to click or other activities undertaken on our Website. Legal basis – a legitimate interest (Article 6 (1) (f) of the GDPR), consisting in facilitating the use of services provided electronically and improving the functionality of these services.

7. The transfer of personal data to the KWC is voluntary, in connection with concluded sales agreements or provision of services via the Website.

§ 2Who is sharing data and how long it is stored.

1. The User’s personal data is provided to service providers used by the KWC when running the Website. Service providers to whom personal data are transferred, depending on contractual arrangements and circumstances, are subject to the instructions of the KWC as to the purposes and methods of data processing (processing entities include, among others, providers providing hosting services, accounting services, providing marketing systems and systems for analyzing traffic on the Website) or not.

2. Service providers are based mainly in Poland and other countries of the European Economic Area (EEA).

3. Users’ personal data is stored:

  • If the basis for the processing of personal data is consent, the personal data of the User are processed by the KWC until the consent is canceled and the consent is canceled for a period corresponding to the period of limitation of claims that may raise the KWC and which can be raised against it. Unless a special provision provides otherwise, for claims related to running a business – three years.
  • In the event that the data processing is based on the performance of the contract, the User’s personal data are processed by the KWC as long as it is necessary to perform the contract, and after that for the period corresponding to the period of limitation of claims. 4. The navigation data may be used to provide Users with better service, statistical data analysis and adaptation of the Website to Users’ preferences, as well as the administration of the Website.

5. If the request is sent, KWC provides personal data to authorized state authorities, in particular to the organizational units of the Prosecutor’s Office, the Police, the President of the Office for Personal Data Protection, the President of the Office of Competition and Consumer Protection, or the President of the Office of Electronic Communications.

§ 3Cookie mechanism and IP address.

1. The website uses small files, called cookies. They are saved by the KWC on the end device of the person visiting the Website, if the web browser allows it. A cookie file usually contains the domain name from which it comes, its “expiration time” and an individual, randomly selected number identifying this file.The information collected using this type of files help adapt the products offered by KWC to individual preferences and real needs of people visiting the Website. They also provide the opportunity to develop general statistics of visits to the presented products on the Website.

2. KWC uses four types of cookies:

  • Session cookies: after completing a session of a given browser or turning off the computer, stored information is removed from the device’s memory. The mechanism of session cookies does not allow the collection of any personal data or any confidential information from the Users’ computers.
  • Persistent cookies: they are stored in the memory of the end device of the User and remain there until they are deleted or expired. The mechanism of persistent cookies does not allow the collection of any personal data or any confidential information from the Users computer.
  • Own Cookies: for the purposes of analysis and research, and audience audits, and in particular to create anonymous statistics that help to understand how Users use the Website, which allows improving its structure and content.
  • External cookies: in order to collect general and anonymous static data via analytical tools of Google Analytics (external cookie administrator: Google Inc. with its registered office in the USA).

3. The cookie mechanism is safe for computers of the Website Users. In particular, this way it is not possible to get viruses or other unwanted software or malicious software onto users’ computers. Nevertheless, in their browsers, Users have the option of limiting or disabling access of cookies to computers. If you use this option, the use of the Website will be possible, in addition to functions that, by their nature, require cookies.

4. KWC may collect Users’ IP addresses. An IP address is a number assigned to the computer of the visitor of the Website by the ISP. The IP number allows access to the Internet. In most cases, it is assigned to the computer dynamically, i.e. it changes every time you connect to the Internet. The IP address is used by the KWC in diagnosing technical problems with the server, creating statistical analyzes (eg determining in which regions we note the most visits), as information useful in administering and improving the Website, as well as for security purposes and possible identification of server burdens, unwanted automated programs for viewing the content of the Website.

§ 4Rights of data subjects.

1. The right to withdraw consent – legal basis: art. 7 par. 3 GDPR.

  • The user has the right to withdraw any consent given by the KWC.
  • Withdrawal of consent has effect since the withdrawal of consent.
  • Withdrawal of consent does not affect the processing carried out by the KWC in accordance with the law before its withdrawal.
  • Withdrawal of consent does not entail any negative consequences for the User, but it may prevent further use of services or functionality which, according to the law of the KWC, can only be provided with consent.

2. The right to object to data processing – legal basis: art. 21 GDPR.

  • The User has the right to object at any time – for reasons related to his special situation – to the processing of his personal data, including profiling, if the KWC processes his data based on a legitimate interest, e.g. marketing of KWC products and services, keeping statistics of use from individual functionalities of the Website and facilitating the use of the Website, as well as a satisfaction survey.
  • Resignation in the form of an e-mail from the receipt of marketing messages regarding products or services shall mean the User’s objection to the processing of his personal data, including profiling for these purposes.
  • If the User’s objection turns out to be well founded and the KWC has no other legal basis for the processing of personal data, the User’s personal data will be deleted, the User has objected to the processing of which he / she has acted.

3. The right to delete data (“the right to be forgotten”) – legal basis: art. 17 GDPR.

  • The user has the right to request the removal of all or some personal data.
  • The User has the right to request the deletion of personal data if:
    • personal data are no longer necessary for the purposes for which they were collected or processed.
    • withdrew a specific consent to the extent to which personal data were processed based on his consent.
    • he objected to the use of his data for marketing purposes.
    • personal data is processed unlawfully.
    • personal data must be removed in order to comply with a legal obligation under Union law or the law of the Member State to which the KCP is subject.
  • Despite the request to remove personal data, in connection with opposition or withdrawal of consent, the KWC may retain certain personal data to the extent that the processing is necessary to establish, assert or defend claims, as well as to fulfill a legal obligation requiring processing by law. Union or the law of the Member State to which the KWC is subject. This applies in particular to personal data including: name, surname, e-mail address, which data are kept for the purpose of handling complaints and claims related to the use of KWC services, or additionally the address of residence / mailing address, order number, which data they are kept for the purpose of handling complaints and claims related to concluded sales agreements or provision of services.

4.The right to limit data processing – legal basis: art. 18 GDPR.

  • The user has the right to request a restriction on the processing of his personal data. Submission of a request, until its consideration prevents the use of certain functionalities or services, the use of which will involve the processing of data covered by the request.
  • The user has the right to request a restriction of the use of personal data in the following cases:
    • when it challenges the correctness of its personal data – then the KWC limits its use for the time needed to verify the correctness of data, but no longer than for 14 days.
    • when the data processing is unlawful, and instead of deleting data, the User will demand limitation of their use.
    • when personal data ceased to be necessary for the purposes for which they were collected or used, but they are needed by the User to establish, assert or defend claims.
    • when he objected to the use of his data – then the restriction takes place for the time needed to consider whether – due to the special situation – protection of the User’s interests, rights and freedoms outweighs the interests that the Administrator performs by processing the User’s personal data.

5. The right of access to data – legal basis: art. 15 GDPR.

The User has the right to obtain from the Administrator confirmation whether he processes personal data, and if so, the User has the right to:

  • get access to your personal data.
  • obtain information on the purposes of processing, categories of personal data being processed, the recipients or categories of recipients of this data, the intended period of User’s data storage or criteria for determining this period (when it is not possible to determine the planned data processing period), the rights of the User under the GDPR and on the right to lodge a complaint to the supervisory body, on the source of this data, on automated decision-making, including profiling and on safeguards applied in connection with the transfer of these data outside the European Union.
  • get a copy of your personal data.

6.The right to rectify data – legal basis: art. 16 GDPR.

The User has the right to demand from the Administrator that he or she corrects his / her personal data incorrectly. Taking into account the purposes of processing, the User whose data relates has the right to request supplementing incomplete personal data, including by submitting additional statements, directing the request to the e-mail address in accordance with § 6 of the Privacy Policy.

7. The right to data transfer – legal basis: art. 20 GDPR.

The User has the right to receive his personal data, which he provided to the Administrator, and then send them to another personal data administrator of his choice. The User also has the right to demand that personal data be sent by the Administrator directly to such administrator, if it is technically possible. In this case, the Administrator will send the User’s personal data in the form of a file in csv format, which is a widely used, machine-readable format that allows sending the received data to another personal data administrator.

8. In the event of the User having the right arising from the above rights, the KWC fulfills the request or refuses to meet it promptly, however not later than within one month after its receipt. If, however, due to the complexity of the request or the number of requests, the KWC will not be able to meet the request within a month, it will meet them within the next three months by informing the User within one month of receiving the request for the intended extension and its reasons.

9. The User may submit complaints, queries and requests to the Administrator regarding the processing of his personal data and the exercise of his rights.

10. The User has the right to lodge a complaint to the President of the Office for Personal Data Protection in the scope of violation of his rights to the protection of personal data or other rights granted pursuant to the GDPR.

§ 5Safety management.

1. KWC provides Users with a secure and encrypted connection when transferring personal data. KWC uses an SSL certificate issued by one of the world’s leading companies in the field of security and encryption of data transmitted via the Internet.

2. The KWC never sends any correspondence, including electronic correspondence, with a request for any login data, in particular an access password to the User’s bank account.

§ 6Changes to the privacy policy.

1. The Privacy Policy may be subject to change, which will be notified by the KWC in advance of 14 days.
